NOTICE - SEA ME WE INTERNATIONAL SUBMARINE CABLE

ACCESS TO CAPACITY OF THE
INTERNATIONAL SUBMARINE CABLE SYSTEM CONNECTING
SOUTH EAST ASIA. MIDDLE EAST
AND WESTERN EUROPE (SEA-ME-WE)
Pursuant to
the investigation carried out by the Telecommunications Regulatory
Commission of Sri Lanka (TRCSL) all operators who are permitted by their
licences to have their own international transmission infrastructure could
now purchase IRUs (Indefensible Right to Use) in the cable capacity of the
SEA-ME-WE3. (Submarine cable connecting South East Asia, Middle East and
Western Europe). Purchase of IRUs will be subject to the approval of the
SEA-ME-WE Management Committee, and the IRU Sales Agreement will have to
be signed according to the SEA ME WE 3. Construction and Maintenance
Agreement (C&MA). Payments for IRUs
will have to be made upfront to the
SEA-ME WE 3 Central Billing Party (CBP).
In case of a wholly owned subsidiary, of a cable partner to whom capacity
is transferred by the principal, such party will not only have to make a payment
for the capacity but also will have to make a nominal payment for
the terrestrial Part (portion on land) of the cable to Sri
Lanka Telecom. Such payment will have to
be made only on the approval of
the TRCSL under Section
5k of the Sri Lanka Telecommunications Act
25 of 1991 as amended by Act No. 27 of 1996. 25 of 199I as amended
by Act No. 27 of 1996.
